INTRODUCTION
Thank you for trusting HerLens. Please read these Terms and Conditions (the "Terms") carefully before using the HerLens mobile application, website, and all related features and services (collectively, the "Platform").
These Terms form a legally binding agreement between you ("User", "you") and PT HerLens Tekno Medika ("HerLens", "we", "us"), and are an inseparable part of our Privacy Policy.
By downloading, accessing, or using the Platform, you are deemed to have read, understood, and agreed to all of these Terms. If you do not agree to these Terms, please do not use the Platform.
1. GENERAL TERMS
In these Terms, the following terms have the following meanings:
a. "Platform" means the HerLens software categorized as Software as a Medical Device (SaMD) pursuant to the Decree of the Minister of Health No. HK.01.07/MENKES/951/2026, including version updates, screening features, AI-based image analysis, the website, and related services.
b. "User" means a qualified, officially licensed, and authorized healthcare professional who uses the Platform to provide healthcare services to patients.
c. "Patient" means a natural person who undergoes an examination using the Platform through a User.
d. "Content" means all data, images, results, and information processed through the Platform.
e. "AI Result" means the preliminary classification and confidence score generated by the artificial intelligence model on the Platform.
f. "Specific Personal Data" means personal data relating to health, medical images, and medical history of Patients as regulated under personal data protection laws.
2. NATURE OF SERVICE, LICENSING, AND MEDICAL DISCLAIMER (IMPORTANT)
a. HerLens is a screening aid for women's reproductive health. The Platform provides a preliminary classification and confidence score based on artificial intelligence.
b. The AI Result is NOT a medical diagnosis and does not replace the judgment, examination, or clinical decisions of a qualified healthcare professional.
c. The final clinical decision, diagnosis, and follow-up are entirely the responsibility of the healthcare professional, taking into account the patient's overall clinical condition. The use of the Platform does not create a doctor-patient relationship between HerLens and the Patient.
d. The Platform is not intended for medical emergencies. In an emergency, contact a healthcare facility immediately.
e. The AI Result may have limitations, including the possibility of false positives and false negatives.
f. Compliance with Marketing Authorization and Intended Use: The Platform is developed and operated in accordance with Software as a Medical Device regulations under Decree of the Minister of Health No. HK.01.07/MENKES/951/2026. Users must use the Platform solely in accordance with the intended use established by HerLens and approved by the Ministry of Health of the Republic of Indonesia.
3. SERVICE CONDITIONS & DATA PROTECTION
a. User Eligibility. The Platform is intended solely for qualified healthcare professionals holding a valid Registration Certificate (STR) and Practice License (SIP), and legally authorized to perform relevant medical/screening procedures. You represent that you are at least 18 years old and must provide proof of professional verification upon request by HerLens.
b. Account. You are responsible for keeping your account credentials (password/PIN) confidential and for all activity on your account. You must provide accurate information at registration and keep it updated when it changes.
c. License. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Platform in accordance with these Terms, solely for legitimate healthcare purposes.
d. Obligations regarding Patient Data & Personal Data Protection Law (UU PDP):
- i. Mandatory Patient Consent (Informed Consent): You must obtain separate and explicit consent from the Patient before collecting, entering, uploading, or processing personal data and medical images through the Platform.
- ii. Data Processing Status: In processing Patient Personal Data, the User and/or Healthcare Facility acts as the Data Controller, and HerLens acts as the Data Processor. HerLens only processes data in accordance with legitimate instructions from the User and for providing the Service.
- iii. Use of Anonymized Data for AI Development: User agrees that HerLens has the right to permanently anonymize (de-identify/pseudonymize) Patient medical images and data for research, accuracy enhancement, and AI model re-training, provided that such process complies with personal data protection laws and cannot re-identify the Patient.
- iv. You must comply with all applicable medical confidentiality, medical records, and personal data protection requirements and are responsible for the accuracy of data entered.
4. SOFTWARE MAINTENANCE AND ADVERSE EVENT REPORTING
a. Software Updates & Upgrades: To maintain clinical accuracy, cybersecurity, and regulatory compliance for medical devices, HerLens may perform software and AI model updates from time to time. Users must ensure that their devices run the most up-to-date version of the HerLens application.
b. Adverse Event Reporting: Pursuant to post-market surveillance obligations for software-based medical devices, Users agree to immediately notify HerLens through official channels upon discovering fundamental technical malfunctions, recurring analytical errors, or adverse events that could potentially impact patient safety during Platform use.
5. PROHIBITED USE
You must not:
a. use the Platform for any unlawful or unauthorized purpose;
b. access, process, or share patient data without consent or a legal basis;
c. reverse engineer, decompile, or disassemble the Platform or its embedded AI model;
d. disrupt, damage, or attempt to gain unauthorized access to our systems or networks;
e. copy, modify, distribute, or resell the Platform or any part of it; and/or
f. use the Platform in any way that could endanger patient safety or deviate from its intended use.
6. INTELLECTUAL PROPERTY
All intellectual property rights in the Platform, including software, algorithms, the AI model, design, trademarks, and our content, belong to PT HerLens Tekno Medika or its licensors. These Terms do not transfer any ownership rights to you.
7. THIRD-PARTY SERVICES
The Platform may use qualified third-party services, including cloud storage that complies with health data security standards. Use of such services may be subject to the respective third party's terms and policies. We are not responsible for the acts or omissions of third parties beyond our control.
8. AVAILABILITY, SUSPENSION, AND TERMINATION
a. We strive to keep the Platform available, but do not guarantee that it will be uninterrupted or completely error-free.
b. We may modify, suspend, or discontinue all or part of the Platform's features at any time with reasonable notice where practicable for maintenance, security, or regulatory compliance reasons.
c. We may suspend or terminate your access if you breach these Terms, upon revocation of your SIP/STR, or to protect the safety and security of other users/patients.
9. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
a. To the extent permitted by law, the Platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties as to the accuracy of the AI Result, fitness for a particular purpose, or uninterrupted availability.
b. To the extent permitted by law, PT HerLens Tekno Medika is not liable for indirect, incidental, special, or consequential damages arising from the use of, or inability to use, the Platform.
c. Given the Platform's nature as a screening aid, clinical decisions, diagnoses, or follow-up made by healthcare professionals are not our responsibility.
d. These Terms do not limit liability that cannot be excluded by law.
10. INDEMNIFICATION
You agree to release and indemnify PT HerLens Tekno Medika against any third-party claims, losses, or demands arising from your breach of these Terms, applicable law, or third-party rights, including failure to obtain patient consent.
11. USER REPRESENTATIONS AND WARRANTIES
By using the Platform, you represent and warrant that:
a. you are a qualified healthcare professional with lawful authority (holding active STR and SIP);
b. you will use the Platform in accordance with these Terms and only for legitimate healthcare purposes;
c. you have obtained valid and explicit consent from the patient before processing patient data; and
d. all information you provide is true, accurate, and current.
12. GOVERNING LAW AND DISPUTE RESOLUTION
a. These Terms are governed by and construed under the laws of the Republic of Indonesia.
b. Any dispute arising out of or in connection with these Terms shall first be resolved amicably through deliberations within 30 (thirty) calendar days. If no settlement is reached, the dispute shall be submitted to the Central Jakarta District Court.
13. CHANGES TO THE TERMS
We may update these Terms from time to time to align with technology updates or regulatory requirements. Material changes will be notified through the Platform and/or our official channels. Continued use of the Platform after the changes take effect constitutes your acceptance of the updated Terms.

15. LANGUAGE
These Terms are made in Indonesian and English. In the event of any difference or conflict of interpretation between the two versions, the Indonesian version shall prevail.
